Consumer alleges Equifax, Sarma Collections provided false information

TYLER — A consumer is suing credit reporting agencies, alleging they provided false information.

Victor McDonald filed a complaint on Aug. 15 in the Tyler Division of the Eastern District of Texas against Sarma Collections Inc. and Equifax Information Services LLC, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, McDonald's information was being reported by the defendants to credit reporting agencies. The plaintiff said he sent a dispute letter June 6, 2018, to Equifax about an account about which the defendant had reported. 

The suit states the account was updated in October 2018 but failed to mark as disputed on the updated credit report. The defendant's failure to properly update the account caused the plaintiff to suffer financial and economical damages to his credit score, the suit alleges.

McDonald seeks trial by jury, attorney fees, court costs and all other just and proper relief. He is represented by attorneys Gregory S. Motil, Joel S. Halvorsen, Gregory M. Klote of Halvorsen Klote in St. Louis.
