HOUSTON — A Harris County man is suing a realty team, alleging he was misled about the condition of a Houston property.
Joshua Brunner filed a complaint Aug. 13 in the Harris County District Court against NetWorth Realty of Houston LLC, Gold Coast Equity LLC, Patten Law Firm PC and Texas American Title Company, alleging violation of the Deceptive Trade Practices Act, fraud, breach of fiduciary duties and negligent misrepresentation.
According to the complaint, Brunner was contacted Dec. 3, 2018, by a sales agent about a property at 304 E. 40th St., Houston. The plaintiff said he agreed to have a survey of the property done and that the defendants did not inform Brunner of any property defects.
The plaintiff said he was told that the closing team would handle the closing transaction and Brunner was e-mailed a title commitment for the property Dec. 10, 2018, for which he had purchased for $76,900. The plaintiff said he only found out about the defects in the property on March 20, 2019, upon review of the closing papers.
Brunner seeks between $200,000 and $1 million, trial by jury, interest, attorney fees, court costs and all other just relief. He is represented by attorney Chase A. Cobern of Munck Wilson Mandala LLP in Dallas.
