Consumer accuses Nexcar Finance of telemarketing scheme

HOUSTON — A Florida man is suing a finance company, alleging that he was made the victim of a telemarketing scheme.

Mohammad Alzoubi, individually and on behalf of all others similarly situated, filed a class action complaint Aug. 12 in the Houston Division of the Southern District of Texas against Nexcar Finance & Leasing LLC, alleging violation of the Telephone Consumer Protection Act.

The plaintiff alleges that the defendant began sending text messages to him June 6, to which Alzoubi had not consented. The messages received by the plaintiff were mass text messages and allegedly were sent to many recipients.

Alzoubi seeks trial by jury, $1,500 for each violation, declaration and injunction against the defendant, actual and statutory damages and all reasonable and just relief. He is represented by attorneys  Angelica M. Gentile and Andrew J. Shamis of Shamis and Gentile PA in Miami.
