Employee accuses Xcalibur Logistics of racial discrimination

HOUSTON — An Upshur County man is suing a Houston logistics business, alleging he was mistreated because of his race.

Christopher Johnson filed a complaint Aug. 12 in the Houston Division of the Southern District of Texas against Xcalibur Logistics, alleging racial discrimination, retaliation and violation of the 1964 Civil Rights Act.

According to the complaint, on March 12, 2018, Johnson, an African-American male, became involved in a disagreement with another employee who was treating him badly. The plaintiff said he was later threatened by another employee who used racially derogative terms to refer to Johnson held a knife to threaten him. 

The plaintiff alleges he was continually exposed to poor treatment on the basis of his race and has had to be prescribed medications in order to be able to function. Johnson, on one occasion, allegedly was made to drive a deficiently safe truck on a dangerous stretch of highway and, despite making his concerns known, Xcalibur failed to provide the plaintiff with a safer option.

The plaintiff alleges Xcalibur vice president Jeff Maronen openly discouraged employees from making complaints to human resources.

Johnson seeks trial by jury, actual damages, interest, back pay, court costs, attorney fees and other just relief. He is represented by attorney Katrina Patrick of  Bellaire.
