HOUSTON — A New York photographer is suing a Houston museum, alleging her photography was used without her consent.
Debra Rothenberg filed a complaint Aug. 14 in the Houston Division of the Southern District of Texas against The Museum of Fine Arts, Houston, alleging violation of copyright law.
According to the complaint, Rothenberg photographed the World Trade Center on Sept. 11, 2001, and maintained all rights to the photo. The suit states the museum ran the plaintiff's photograph without first attaining her consent to use the photo.
Rothenberg seeks trial by jury, actual damages, punitive damages, attorney fees, court costs and all just and proper relief. The plaintiff is represented by attorney Richard P. Liebowitz of Liebowitz Law Firm in Valley Stream, New York.
