HOUSTON — A Galveston County man is suing a battery manufacturer and distributor, alleging a Samsung battery exploded and caused him injury.
Carlos Johnson filed a complaint Aug. 14 in Harris County District Court against Michael Angelo Perez, doing business as High Velocity, Samsung SDI America Inc., and Midwest Goods Inc., alleging negligence, product liability, breach of implied warranty, breach of express warranty, misrepresentation, fraud, intentional infliction of emotional distress and negligent infliction of emotional distress.
According to the complaint, Johnson purchased two Samsung SDI INR 18650 25R batteries from High Velocity in Galveston County on Oct. 13, 2018. The suit alleges one of the batteries, without warning, exploded in the plaintiff's pocket, resulting in severe burns down his leg, thigh and foot and causing extreme pain, impairment and mental anguish.
Johnson seeks more than $1 million, trial by jury, interest, attorney fees, court expenses and all just relief. He is represented by attorney Cesar Tavares of Williams, Hart, Boundas, Easterby LLP in Houston.
