Elevator rider blames manufacturer for two-story fall

Lawsuits

HOUSTON — A Harris County woman is suing an elevator manufacturer, alleging she was injured due to a malfunctioning elevator.

Sue Klosterman filed a complaint Aug. 21 in Harris County District Court against USAA Real Estate Company and Thyssen Krupp Elevator Corporation, alleging gross negligence, product liability and breach of warranty.

According to the complaint on Jan. 9, Klosterman, who worked for Hewlett Packard, was in the HP Plaza Building parking garage at 10300 Energy Drive in Spring. The plaintiff said she entered the elevator on the third floor but the elevator dropped uncontrollably and crashed into the first floor.

The plaintiff says she was jolted by the fall and sustained serious injuries due to the defendants' negligence.

Klosterman seeks between $200,000 and $1 million, trial by jury, attorney fees, court costs, interest and all other just relief. She is represented by attorneys Richard M. Grimes and Jennifer B. Swick of Grimes & Fertitta PC in Houston.
