HOUSTON —A Harris County man is suing a group, alleging that he was made the victim of fraud.
Christopher Corrigan filed a complaint on Aug. 22 in the Harris County District Court against Dana Industrial Group LLC, Andrew J. Garcia and Dane A. Fitzgerald alleging breach of contract, promissory estoppel and common law fraud.
The plaintiff was hired as the VP of Sales and Business Development for the defendant on Jan. 1, 2015. The plaintiff was offered 4% commission on all revenue bought by the defendant as well as $200 a week for vehicle and fuel and $600 a month for insurance and business expenses, which the plaintiff accepted. The plaintiff helped the company grow significantly from 0 to 21 million dollars in revenue. Despite the promises made to the plaintiff about the cut of the sales he would receive, the plaintiff was not paid what he was owed and in 2015 the defendants owed him $3,341.41 that they did not pay him. In 2016, the balance owed to the plaintiff was not paid in full and the plaintiff is still owed $105,293.98. In 2017, the amount that the plaintiff was owed but not paid was $348,629.44. In December 2017, the plaintiff was owed a total of $378,264.83 from the defendant. The defendant also, in addition to cheating the plaintiff, misreported their earnings to the IRS. The defendants continued to shortchange the plaintiff and when the plaintiff tried to recover the money he was owed the defendants lied to the plaintiff and said that they needed to look at the numbers. The plaintiff has made a number of demands for payment owed which now totals $95,351.83 but the defendants have denied him the money he is owed.
The plaintiff is seeking between $200,000 and $1 million, trial by jury, attorneys' fees, court costs, interest and just relief. The plaintiff is represented by Jacqueline A. Armstrong of Armstrong & Associates in Houston and Jo Miller of the Law Office of Jo Miller PLLC in Conroe.
