Former employee alleges contractors owe more than $25,000

LUFKIN —A Shelby County man is suing his former employers, alleging he is owed more than $25,000 in overtime.

David Ballard filed a complaint Aug. 28 on in the Lufkin Division of the Eastern District of Texas against K&L Contractors Inc., Ultra Inc., and Chesapeake Energy Corporation, alleging violation of the Fair Labor Standards Act.

According to the complaint, Ballard worked for the defendants from March 2018 to September 2018. During the course of his employment, the plaintiff says he was regularly not paid for overtime hours worked, even though he worked 44-50 hours of overtime on a regular basis. 

Based on the number of hours that the plaintiff worked, the suit alleges, he is entitled to $25,156.95 in liquidated damages according to the FLSA.

Ballard seeks the liquidated damages, attorney fees, interest, all just relief and court costs. He is represented by attorneys Alan Braun and Adam Poncio of Poncio Law Offices in San Antonio.
