Customer alleges Gulf Stream Coach sold RV that malfunctioned

HOUSTON — A customer is suing a Katy  RV company, alleging he was sold a vehicle that malfunctioned.

Gregory George Pinto filed a complaint Aug. 28 in the Houston Division of the Southern District of Texas against Gulf Stream Coach Inc., and Holiday World of Katy LLC, alleging breach of implied and express warranties, violation of the Texas Deceptive Trade Practices Act, violation of the Magnuson-Moss Warranty Act, negligence and breach of contract.

According to the complaint on Jan. 18, 2018, Pinto purchased a new 2017 Gulf Stream Conquest from Holiday World of Katy and paid $64,887 for the RV. The defendant allegedly implied a warranty of merchantability and said that a repair done on the vehicle had been done in a workmanlike manner. 

The suit alleges the Conquest malfunctioned, however, and the defendant has failed to repair the RV, a breach of contract. The plaintiff alleges past and future economic losses, diminution in the value of the Conquest and mental anguish.

Pinto seeks trial by jury, exemplary damages, attorney fees, costs of suit, interest and all appropriate relief. He is represented by attorney Richard C. Dalton of Mandeville, Louisiana.
