Employee alleges Geoscience Engineering failed to pay overtime

HOUSTON — A Harris County man is suing a Houston engineering business, alleging that he was not paid overtime for hours for which he qualified.

Carl Barnett filed a complaint Aug. 28 in the Houston Division of the Southern District of Texas against Geoscience Engineering & Testing Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, Barnett began work for Geoscience in February 2015 in construction materials testing and was paid overtime. The plaintiff alleges that in late 2015 and early 2016 he was misclassified as an exempt employee and no longer paid overtime although he regularly was made to work more than 40 hours a week. 

The plaintiff states he should have been compensated at a rate of time and a half for all hours worked in excess of 40 per week as required by the FLSA. 

Barnett seeks trial by jury, all unpaid overtime compensation, compensatory damages, interest, attorney fees, court costs and all just relief. He is represented by attorneys Derrick A. Reed and Marrick Armstrong of Stephens Reed & Armstrong PLLC in Pearland.
