Employee alleges Southern Tool Inspection failed to pay proper overtime

HOUSTON — A Montgomery County man is suing a mortgage industry business, alleging he was not paid the overtime pay to which he was entitled.

Seth Cole, on behalf of himself and all others similarly situated, filed a class action complaint Aug. 28 in the Houston Division of the Southern District of Texas against Southern Tool Inspection LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Cole worked for Southern Tool as an oil field inspector, was paid a salary and was classified as exempt. The suit states Cole often worked more than 40 hours per week but the defendant did not pay him for overtime work and threatened the plaintiff if he tried to find overtime pay elsewhere. 

The plaintiff alleges he did not receive a large enough salary to be exempt from overtime wages and that Southern Tool also failed to keep accurate records of the hours that Cole worked.

Cole seeks trial by jury, compensatory damages, interest, attorney fees, court costs and all just relief. He is represented by attorney Clayton D. Craighead of The Craighead Law Firm PLLC in Houston.
