Luis Gomez Gonzalez has filed a lawsuit against CBOCS, Inc., alleging negligence after suffering injuries at one of the company's restaurant locations. The complaint was lodged in Harris County, Texas, on February 12, 2025. Gonzalez claims that CBOCS, Inc., which operates Cracker Barrel Old Country Store, failed to maintain safe premises, leading to his severe injuries.
According to the court documents, the incident occurred on March 16, 2024, when Gonzalez visited the Cracker Barrel located at 24400 Eastex Freeway in Kingwood Area, Texas. While there as an invitee for mutual business benefit with the defendant's establishment, he tripped over a negligently maintained steel cable on the premises. This accident resulted in significant injuries that have required ongoing medical attention. The plaintiff argues that CBOCS, Inc., as the owner and operator of the restaurant, had a duty to ensure the safety of its patrons by maintaining hazard-free conditions and failed to do so.
Gonzalez's petition outlines several allegations against CBOCS, Inc., including failure to inspect and remedy dangerous conditions such as the steel cable that caused his fall. He accuses them of not warning him about potential hazards and lacking proper procedures for ensuring customer safety. Furthermore, he claims negligent hiring and supervision of employees who were responsible for maintaining safe conditions within the restaurant.
The plaintiff is seeking $73,000 in damages for medical expenses incurred since March 16, 2024, along with compensation for physical pain and suffering, mental anguish, lost wages and earning capacity due to his injuries. Additionally, Gonzalez requests pre-judgment interest from the date of injury until judgment is rendered and post-judgment interest at legal rates alongside court costs.
