Homebuyer alleges builder failed to divulge dangers of flooding

HOUSTON — A Humble woman and 15 other plaintiffs are suing a building company, alleging they were sold homes that flooded, contrary to representations from the builder.

Esperonica Bryant et al filed a class action complaint Aug. 26 in Harris County District Court against Greeneco Builders LLC, Amcap Mortgage Ltd., Cornerstone Home Lending Inc., & Ecoinsurance Agency LP, alleging breach of contract, fraud, breach of warranties, negligence, violation of the Deceptive Trade Practices Act and conspiracy.

According to the complaint, Bryant is a homeowner in the Arbor Trails subdivision in Harris County. The suit states she purchased a new single-family home that was built by Greeneco throughout 2017. 

Bryant alleges she sustained catastrophic damages when the defendant's construction failed to keep out heavy rain water from flooding that occurred during Hurricane Harvey. The plaintiff said she has been convinced not to purchase flood insurance and, as such, suffered the monetary damages associated with the hurricane and had to pay out of pocket. 

The suit states Greeneco had made representations to the plaintiffs that guaranteed the homes to be of a high standard. Bryant alleges her home flooded shortly after she moved in due to the defendant's negligence in construction and failure to make the proper accommodations to ensure that the homes were built to withstand any possible flooding. 

Bryant says had she been aware of the possibility of flooding, she would have made a different decision regarding the purchase of the home and/or the purchase of flood insurance, leaving the defendants liable for the damages suffered by the plaintiffs.

Bryant and the other plaintiffs seek monetary damages of more than $1 million, trial by jury, attorney fees, court costs, interest and all other just relief. They are represented by attorneys Husein Hadi, Jamil Thomas, Carnegie H. Mims of The Hadi Law Firm PLLC in Houston.
