Allstate hit with $30K verdict in suit over underinsured benefits

BEAUMONT – A jury recently awarded a Port Arthur man more than $30,000 in damages in a lawsuit brought over underinsured motorist benefits.

Seeking up to $500,000 in damages, Willie LaDay filed suit against Allstate Fire and Casualty Insurance on Nov. 14, 2017, in Jefferson County District Court.

Nearly two years later, the case was called up for trial and ended with jurors awarding LaDay $25,000 for his past and future mental anguish, plus $15,803.78 for his past medical expenses.

No damages were awarded for his alleged past and future impairment, according to the charge of the court, filed on Sept. 9.

According to the original petition, on March 3, 2016, LaDay was a passenger in a vehicle being driven by his wife. They were traveling south on Highway 347 when another vehicle rear-ended them.

As a result of the collision, LaDay claims he incurred more than $16,000 in medical expenses.

He asserts Allstate refused to compensate him for underinsured motorist benefits under the policy.

LaDay is represented by Tom Oxford, attorney for the Beaumont law firm of Waldman Smallwood.

Judge Kent Walston, 58th District Court, presided over the case.
