Mother alleges bar's negligence responsible for drunk driver who killed her son

HOUSTON —The mother of a deceased man is suing a Harris County bar, alleging it was responsible for overserving a customer who ended up killing the plaintiff's son in a vehicle crash.

Patricia Vela, individually and as representative of the estate of Christian Morales, deceased filed a complaint Aug. 29 in Harris County District Court against Active Park LLC doing business as Prospect Park, alleging liability, gross negligence and wrongful death.

According to the complaint, on March 16, Morales, was driving north on state Highway 249 when Montreal Landry was driving south on the same road. Landry allegedly struck Morales' car and the plaintiff died at the scene while Landry died later from his injuries. 

The suit alleges Landry had been a patron of the defendant's Prospect Park bar in Harris County, and was intoxicated when he left. The lawsuit states this made the defendant negligent and responsible for the collision.

Vela seeks more than $1 million, attorney fees, court costs, interest and all just relief. She is represented by attorneys Muhammad S. Aziz and Angelina Wike of Abraham Watkins Nichols Sorrels Agosto & Aziz in Houston and by Bilaal Badat of The Law Office of Bilaal Baddat PLLC in Houston.
