Auto delivery man alleges Katy dealership caused fall, injuries

HOUSTON — A Houston man is suing a Katy auto dealership, alleging he was injured when he fell due to a dangerous condition.

Ricky Dears and Denise Whitener filed a complaint on Aug. 29 in the Harris County District Court against Autonation Ford Katy also known as Texan Ford Inc., alleging negligence,

According to the complaint, on Nov. 1, 2017, Dears was at 20777 Katy Freeway, delivering new vehicles to the dealership. The suit alleges Dears had to unload the vehicles along the back fence line, which required walking on an area of pavement that was unpaved and sagging with pooled water and mud. The plaintiff alleges this condition caused him to slip and fall, leading to a fracture of his right patellar, which required surgery.

Dears' wife Whitener alleges loss of consortium.

Dears and Whitener seek more $1 million in monetary relief, trial by jury, attorney fees, court costs, interest and all equitable and just relief. They are represented by attorneys Sean Patrick Tracey, Shawn P. Fox, Scott C. Greenlee and Lance Nolan Walters of Tracey & Fox Law Firm in Houston.
