Pasadena apartment tenant alleges injuries due to falling awning

HOUSTON — A Pasadena tenant is suing apartment management, alleging she was injured due to a falling awning.

Krystal M. Martinez filed a complaint Aug. 29 in Harris County District Court against Derbyshire Investments Pasadena LLC, alleging negligence.

According to the complaint on Nov. 14, 2017, Martinez was at Maple Trail Apartments, 2001 Burke Road, Pasadena. The suit says the plaintiff was walking underneath an awning when it collapsed, striking her on the right should and back and causing injuries so severe that the plaintiff suffered a loss of earning capacity. 

The plaintiff alleges this incident occurred after she had made several requests to Derbyshire to repair the awning.

Martinez seeks between $200,000 and $1 million, attorney fees, court costs, interest and all just relief. She is represented by attorney Camilo Valencia of Ben Abbott & Associates PLLC in Garland.
