Houston property buyer alleges title company failed to disclose pertinent information

HOUSTON — A Harris County woman is suing a title company, alleging the defendants were negligent in the disclosure of information about a Houston property the plaintiff purchased.

Veronica Paz filed a complaint on Sept. 17 in the Harris County District Court against Precision Surveyors and Chicago Title alleging negligence, breach of fiduciary duty and breach of contract. 

According to the complaint, Paz purchased a property at 6455 Cunningham Road, Houston, on Dec. 2, 2016. Chicago Title, the suit states, was employed to guarantee that the title was complete and clear of any defect. 

The suit alleges Precision Surveyors did not include information about the easement owned by West Harris County Regional Water Authority (WHCRWA), the title to the property was not clear and complete and the WHCRWA began proceedings to get access to the easement. 

The defendants allegedly failed to inform Paz that this was taking place and the plaintiff was caused damage due to the easement. 

The plaintiff states she has been forced to move and physically restructure two buildings that had been erected on the easement. She alleges the defendants were negligent failing to exercise due caution.

Paz seeks monetary relief between $60,000 and $250,000, interest, court costs, attorney fees and all other just relief. She is represented by attorney Thomas P. Nixon of the Law Office of Nixon and Associates PC in Houston.
