Galveston Historical Foundation alleges owner breached contract for upkeep of property

GALVESTON — A historical foundation is suing a Galveston woman who has allegedly breached their contract regarding upkeep of a property on 34th Street.

Galveston Historical Foundation Inc., filed a complaint Sept. 13 in Galveston County District Court against Delores J. Williams, alleging breach of contract.

According to the complaint, on May 18, 1984, the foundation deeded the property at 1220 34th St., Galveston, to Williams and reserved the rights to enforce certain maintenance and upkeep covenants of the property. The suit states Williams agreed to the terms but then failed to keep up with the duties outlined, including failing to mow the lot, repair broken windows and replace missing steps. 

The plaintiff alleged it is seeking a remedy of the situation as they have given Williams 30 days' notice but still have not received an answer from the defendant.

The Galveston Historical Foundation seeks damages of $100,000 or less, attorney fees, court costs, interest and all other just relief. It is represented by attorneys David J. Booth and Victoria S. Rutherford of Greer, Herz & Adams LLP in Galveston.
