Employee alleges MUY Pizza Houston failed to pay appropriate overtime wage

HOUSTON — A Harris County man is suing a Houston pizza business, alleging he was not paid the appropriate wage for overtime hours worked.

Willie Charles Oliver Jr., on behalf of himself and all others similarly situated, filed a class action complaint Sept. 10 in the Houston Division of the Southern District of Texas against MUY Pizza Houston LLC, alleging violation of the Fair Labor Standards Act. 

According to the complaint, during the course of Oliver's work with MUY Pizza he was told he was expected to work 50 hours per week, well in excess of 40 hours a week that defines overtime. Despite working overtime, the plaintiff said he was not paid at the appropriate overtime wage rate as required by FLSA. The plaintiff said he also was fearful that if he worked fewer than 50 hours a week that he would be docked in pay.

Oliver seeks compensatory damages, trial by jury, attorney fees, court costs, interest and all just relief. The plaintiff is represented by Sara Richey of The Richey Law Firm in Houston and Clayton D. Craighead of The Craighead Law Firm in Houston.
