Independent Steel alleges Galveston construction company owes more than $21,000 for materials

GALVESTON — Independent Steel Erectors is suing a Galveston construction company as part of the plaintiff's efforts to collect more than $20,000 for construction equipment.

Independent Steel Erectors Inc. filed a complaint Nov. 19 in the Galveston County District Court against J Benham Construction, Inc (JBC) and Jamie Benham, alleging liability. 

According to the complaint, Independent sold JBC $46,406.75 worth of "goods, wares, merchandise or services" for a construction improvement project in Galveston that involved erecting "metal building and related materials."  Independent alleges JBC is in default on its balance of $21,706.76 that was due April 30, 2019 and has breached its credit agreement despite repeated requests for payment.

Independent seeks monetary relief of $21,706.76 plus $10,000 in attorney fees, court costs. interest at 5 percent per annum and all other just relief. It is represented by attorney Charles Wear, Jr of The Law Offices of Charles E. Wear, Jr PC in Arlington.
