HOUSTON — A Tomball couple is suing Monsanto, alleging the husband's exposure to Roundup caused his leukemia.

Otis Chapman and Kim Chapman filed a complaint  Dec. 2 in the Houston Division of the Southern District of Texas against Monsanto Company, alleging strict liability, breach of express warranty and breach of implied warranty of merchantability

According to the complaint, Otis Chapman, who was diagnosed with chronic lymphocytic leukemia in February 2003, was exposed to the herbicide Roundup from 1995 through 2004 while using the product on his property.

The plaintiffs allege Monsanto failed to disclose "critical safety information" about Roundup's ingredients, glyphosate and "falsely represented the safety" of it products despite the International Agency Research on Cancer (IARC) and the World Health Organization (WHO) tracing health issues to exposure to glyphosate since 2001.

The Chapmans seek compensatory and punitive damages, trial by jury, court costs, attorney fees and all other just and proper relief. They are represented by attorney Robert Collins of Robert L. Collins & Associates in Houston.
