ProCollect accused of illegal cell phone calls to collect on imaginary debt

HOUSTON — A Fort Bend County man alleges ProCollect illegally called him on his cell phone to collect a debt he says he does not owe. 

Jesus Perez filed a complaint Dec. 13 in the Houston Division of the Southern District of Texas against ProCollect, alleging violation of the Fair Debt Collection Practices Act (FDCPA), Texas Debt Collection Act and the Telephone Consumer Protection Act (TCPA).

Perez alleges ProCollect began calling him on his cell phone to collect a debt he does not owe. Perez says in December 2018 and in August 2019 he spoke with one of the collectors and asked that they stop the calls and stop invading his privacy. 

The plaintiff alleges he has faced cell phone charges for the incoming calls and that within the four years since his filing his complaint ProCollect has used an automatic telephone dialing system and has left both prerecorded and live operator voicemail messages.

Perez seeks $500 in statuary damages for every violation, treble damages, injunctive relief and all other appropriate relief. He is represented by attorney Taylor Kosla of The Arguss Law Firm LLC in Chicago.
