Father alleges illegal collection calls over his daughter's medical debt

TYLER — A Gilmer man alleges he received unwarranted calls on his cellphone regarding his minor daughter's medical debt. 

Martin Blasnek filed a complaint  Dec. 13 in the Tyler Division of the Eastern District of Texas against Edward Sloan and Associates Inc., (ESA) alleging violation of the Fair Debt Collection Practices Act.

Blasnek alleges that "years ago" he began to receive calls on his cell phone from ESA in an attempt to collect the debt he incurred due to his minor daughter's medical care. He says he informed the ESA representative that he could not afford to make any payments at the time and requested that they stop calling. The plaintiff also alleges he received "automated/prerecorded" messages from ESA , including "dozens" of calls. 

Blasnek seeks trial by jury, statutory damages of $500 for each violation and up to $1,500 in treble damages for each violation, trial by jury and all other just and proper relief.
