Boy nearly drowns at Harold's Fun Town water park, lawsuit seeks more than $1M in damages

GALVESTON — Harold's Fun Town Water Park faces a negligence suit after a boy allegedly was sucked into an uncovered drain and nearly drowned. 

Jamie Blackburn and Ron Hoss Strimple, individually and as next friend of C.S. ,filed a complaint Dec. 12 in Galveston County Court against Atain Speciality Insurance Company and Harold's Fun Town LLC, alleging gross negligence. 

According to the complaint, Blackburn's son C.S. was injured Aug. 10, at the Harold's Fun Town water park in Winnie when he was "sucked into the drain and almost drown" due to a missing drain cover. Blackburn alleges the water park was negligent for not securing the drain. He also alleges negligence for Atain's, the water park's liability carrier,  for failing to inspect the park prior to a permit being issued. 

Blackburn and Strimple seek monetary relief of more than $1 million, interest, court costs and all other just relief. They are represented by attorney Alton Todd of The Law Firm of Alton C. Todd PC in Friendswood.
