Cypress couple alleges home equity loan did not comply with state law

HOUSTON  — A Harris County couple alleges Loan Depot failed to fix the defects in its home equity lien and collection of mortgage payments that did not comply with state law. 

Joseph Jones and Trina Jones filed a complaint Dec. 10 in Harris County District Court  https://jnswire.s3.amazonaws.com/jns-media/56/73/10402769/201987229.PDF against Loan Depot.com  alleging breach of contract and violation of the Texas Constitution. 

The Joneses allege the home equity loan they obtained from Loan Depot on Feb. 10, 2017, contained "constitutional violations" for the plaintiffs' property at 14410 Cypress Drive, Cypress. According to their suit, the violations include not receiving in the required time frame a copy of their final executed loan documents, a final itemization and failing to acknowledge fair market value on the day of their closing. 

The Jones seek monetary relief of more than $50,000, trial by jury, interest and all other just relief. They are represented by attorneys Robert Lane, Joshua Gordon and Tyler Basham of The Lane Law Firm PLLC in Houston.
