Worker struck in the head by falling metal at Exxon's Baytown Refinery claims negligence

HOUSTON – A worker who was struck in the head by falling metal while working at Exxon's Baytown Refinery is claiming negligence. 

Ivan Alvarez filed a complaint Dec. 17 in the Harris County District Court against Bechtel Construction Company and Exxon Mobil Corporation alleging negligence and premises liability. 

According to Alvarez complaint, he was working on scaffolding at Exxon's Baytown Refinery on Dec. 28, 2017, when a "large metal angel" fell and hit him on the head and caused him to fall several feet. Alvarez claims that Exxon and Bechtel, who was responsible for overseeing the safety practices and polices on the premises, failed to maintain and inspect the area for any hazards.  

Alvarez seeks monetary relief of more than $1 million, trial by jury, interest and all other just relief. He is represented by Kyle Herbert and Rachel Berkley of The Herbert Law Firm PLLC in Houston.
