Denvers man claims he lost more than $1 million due to breach of contract

HOUSTON — A Denvers, Texas man is claiming breach of contract in a more than $1 million business deal. 

Kevin Herbert filed a complaint Dec. 26 in the Harris County District Court against Joe Leteff alleging fraud, breach of contract, quantum meruit, conversion, unjust enrichment and breach of fiduciary duty. 

Herbert alleges in his complaint that per a signed agreement, Leteff was to release 40 percent of ownership in Champion Turnaround Services to him for payroll and operating expenses and bringing in new business. Herbert claims he gave Leteff more than $100,000 which Leteff used for "personal use" without informing Herbert and refusing to return the money. 

Herbert seeks monetary relief between $100,000 and $200,000, trial by jury, interest and all other just relief. He is represented by attorney Timothy Hootman in Houston and Gary Patteron of Gary E. Patterson PC in Houston.
