Apartment complex owner, manager face suit after man is robbed, shot, killed in parking lot

HOUSTON — The widow and children of a man who was shot during an attempted robbery at his apartment complex is alleging the negligence of the property's owner and management company.

Ebony Gause, individually and as representative of the Estate of Godwin Chika and as guardian of and on behalf of E.A.C., a minor and Jaqwin Miller filed a complaint Jan. 5 in the Harris County District Court against Firmus JCR Owner Olympia LLC and Firmus Management and Construction LLC alleging wrongful death, gross negligence and public nuisance.

Chika lived at the defendant's Olympia Flats Apartments and worked as a taxi driver for Yellow Cab. Chika was shot and killed in the parking lot of the apartment complex on March 7, 2018 during an attempted robbery. His wife Gause and children Miller and E.A.C. allege the apartment complex and surrounding area was known for drug dealings and other criminal activity but failed to take security measures. 

The plaintiffs seek monetary relief, trial by jury, interest and all other just relief. They are represented by Marshall May and Michael Goldman of The Law Office of Marshall May LLC in Dallas.
