Man claims negligence of two Houston physicians after requiring corrective orthopedic surgery

HOUSTON — A man is suing two Houston area physicians after he suffered from complications from orthopedic surgery and required a corrective surgery on his leg. 

Carl Smelser filed a complaint https://jnswire.s3.amazonaws.com/jns-media/86/39/11309089/88759000.PDF Jan. 3 in the Harris County District Court against All American Orthopedic & Sports Medicine Institute, Marston Holt, M.D., and Jeffrey Jaglowski, M.D., alleging negligence. 

Smelser suffered a broken leg after a fall on Jan. 1, 2018. He suffered further injury from another fall several days with Jaglowski referring him to Holt who performed surgery on Smelser's injury. He alleges that due to a "malunion" caused by Holt's surgery, he required corrective surgery and has suffered from leg and hip pain which could be chronic. He also alleges that Jaglowski was aware of the malunion but falsely claimed there were no physicians in the Houston area qualified to fix the issue.

Smelser seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Joshua Anderson of Horne Rota Moos LLP in Houston.
