Harris County man claims he received unsolicited faxes, cell phone calls from several businesses

HOUSTON — A Harris County man has filed a class action suit against several businesses claiming he received unsolicited faxes and cell phone calls in violation of federal law. 

David Schein, individually and on behalf of all others similarly situated, filed a complaint Jan. 17 in the Houston Division of the Southern District of Texas  against MDU Resources Group Inc., Rickey Evans doing business as Certified Commerical Roofing and others alleging violation of the Telephone Consumer Protection Act (TCPA) and Junk Fax Prevention Act. 

Schein, who had registered on the National Do Not Call Registry in 2003, alleges the defendants used his and the other plaintiffs' cell phone and fax numbers to send unsolicited faxes and calls using automatic telephone dialing equipment. He claims he never gave permission for the defendants to contact his cell phone or send the faxes which were used to solicit business. 

Schein seeks monetary relief of $500 for each fax message in violation of the TCPA, trial by jury and all other just relief. He is represented by Kevin Michaels of The Law Offices of Kevin Michaels PC in Houston.
