Woman sues J.C. Penney after tripping on torn carpet

HOUSTON — A woman who tripped on torn carpet at a J.C. Penney store and suffered injuries is claiming the stores negligence.

Alicia Trevino Chavez filed a complaint Jan. 23 in the Harris County District Court against J.C. Penney Corporation Inc., alleging negligence. 

Chavez was at the J.C. Penney store in the San Jacinto Mall in Baytown on Nov. 28, 2018. She alleges that she tripped and fell on a torn carpet and suffered injuries. Chavez alleges J.C. Penney "either created the condition" and/or failed to correct the alleged hazard. 

Chavez seeks monetary relief between $200,000 and $1 million, trial by jury, interest and all other just relief. She is represented by Annie Basu of The Basu Law Firm PLLC in Houston.
