Man who sold pharmacy business faces claims of breach of contract, filing false documents with state

RICHMOND — A man who sold his Texas pharmacy to Innovative Pharmacy is facing a breach of contract suit claiming he filed false documents with the state's Secretary of State. 

Innovative Pharmacy Solutions field a complaint Jan, 21 in the Fort Bend County District Court against Timothy Viet Do alleging breach of contract, breach of fiduciary duty and common law fraud. 

Innovative entered into an agreement with Do for the sale of his business, Affordable Pharmacy, on June 20, 2019 and paid Do $54,000. As part of the sale agreement, Innovative also hired Do as a pharmacist and also paid him monthly rent. Innovative alleges Do failed to transfer membership shares of Affordable Pharmacy to them and filed a false document with the Secretary of State of Texas that identified himself as the director of Affordable Pharmacy. Innovative also claims Do incorrectly filled several prescriptions while working for them as a pharmacist.

Innovative seeks monetary relief of $141,976 and all other just relief. They are represented by Robert Vilt and Kerry Prisock of Vilt and Associates PC in Houston.
