Woman sues firearms dealer alleging pistol spontaneously fired causing her injury

AUSTIN — A woman is suing a firearms dealer after suffering permanent injuries when her husband's gun allegedly spontaneously discharged. 

Janeen Dunn filed a complaint Feb. 18 in the U.S. District Court for the Western District of Texas Austin Division against J&G II, Inc., doing business as J&G Sales LTD alleging products liability, negligent marketing and breach of implied warranties.

David Dunn purchased two guns from J&G on Oct. 30, 2017. The Dunns kept one of the purchased guns, a Star BM 9mm VG pistol, in a hall closet loaded, with the safety on. Janeen Dunn alleges that on April 13, 2018, while moving clothes out of the closet, the pistol got knocked off the shelf, hit the granite tile floor and discharged sending shrapnel into her foot. She claims the pistol is defective since it discharged without the trigger being pulled. 

Dunn seeks monetary relief of between $200,000 and $1 million, interest and all other appropriate relief. She is represented by Mark McLean of McLeanLaw PC in Austin.
