DALLAS — A former Buckner Retirement Services social worker alleges she was fired due to her pregnancy.
Shellyann Tommy filed a complaint Feb. 19 in the U.S. District Court for the Northern District of Texas Dallas Division against Buckner Retirement Services Inc., alleging violation of the Civil Rights Act of 1964, Texas Commission on Human Rights and the Family and Medical Leave Act.
Tommy began working for Buckner in January 2018 as a social worker and informed her employer she was pregnant in November 2018. She alleges that after announcing her pregnancy, she received no response to inquiries about who would cover her duties while she was on maternity leave. Tommy claims that during her final trimester in March of 2019, she was fired and told they "could not afford to continue" her employment and was offered two weeks' pay in exchange for signing a discrimination release and waiver.
Tommy seeks monetary relief, interest, a trial by jury and all other just relief. She is represented by Daniel Ross, Charles Scalise and Trenton Lacy of The Ross-Scalise Law Group in Austin.
