Man claims TitleMax continued debt collection attempts after he filed for bankruptcy

AUSTIN — A man is claiming TitleMax continued to call him in an effort to collect a debt after he filed for bankruptcy. 

Manuel Godinez Jr., filed a complaint Feb. 27 in the U.S. District Court for the Western District of Texas Austin Division against TitleMax of Texas Inc., alleging violation of the Telephone Consumer Protection Act. 

Godinez defaulted on a loan he took out with TitleMax. He alleges that in September of 2019, he began to receive calls from TitleMax and on Oct. 11, 2019 filed for Chapter 7 Bankruptcy. He claims despite his informing them of his bankruptcy filing, he continued to receive at least 20 calls from TitleMax in an unlawful attempt to collect his debt. 

Goginez seeks monetary relief, trial by jury and all other just relief. He is represented by Mohammed Badwan and Joseph Davidson of The Sulaiman Law Group LTD in Lombard, Illinois.
