Man claims Worldmark, Wyndham illegally tried to collect debt despite his bankruptcy filing

BEAUMONT — Worldmark and Wyndham Resort are facing a suit alleging they illegally attempted to collect a debt for a timeshare from a man who was under bankruptcy protection.  

David Yeske filed a complaint March 2 in the Beaumont Division of the Eastern District of Texas against Worldmark, The Club and Wyndham Resort Development Corporation alleging violation of the Texas Debt Collection Act.

Yeske filed for bankruptcy on April 9, 2019. He alleges that despite Worldmark and Wyndham being sent formal notices of his bankruptcy case due his timeshare debt, they continued to send him invoices, delinquency notices and a coupon payment book for more than $16,000 in charges plus late fees. Yeske claims that in July of 2019, he also began to receive harassing calls to coerce him into making payments.

Yeske seeks monetary relief, trial by jury, interest and all other just relief. He is represented by James Manchee and Marilyn Altamira of Manchee & Manchee PC in Plano.
