Electrician claims negligence of boom truck manufacturer after having hand crushed

SHERMAN — An electrician is claiming the negligence of a boom truck manufacturer and alleging a faulty joystick caused his hand to be crushed and his thumb to be nearly amputated. 

James Ustanik filed a complaint March 31 in the Sherman Division of the Eastern District of Texas against Elliot Equipment Company alleging liability and negligence.

Ustanik works for Facility Solutions as an electrician. He alleges that on May 14, 2018, he was in the basket of a boom truck manufactured by Elliot Equipment, and was operating the joystick while trying to untangle a cable. Ustanik's hand was pulled in and crushed and he required surgery to reattach his thumb. He alleges the accident was the result of a joystick's failure to work properly.

Ustanik seeks monetary relief of $32,783 in lost earning capacity, $150,000 in past medical expenses, interest and all other appropriate relief. He is represented by John Cummings of Anderson & Cummings LLP in Fort Worth.
