Man shot in head with Glock handgun claims gun discharged even though bullet clip was removed

HOUSTON — A man who was shot in the head by a Glock handgun is suing the gun manufacturer and the shooter claiming the gun discharged even though the bullet clip was removed. 

Devyn Holmes filed a complaint April 1 in Harris County District Court against Cassandra Damper, Jonathan Coleman, Jr., and Glock Inc., alleging negligence. 

Holmes and Damper were sitting in a car parked at a gas station in Houston on April 1, 2018. Holmes alleges that Coleman handed Damper a gun that had a bullet still remaining in the chamber, despite the bullet clip being removed. Holmes claims Damper then pointed the gun at his head and shot him. Holmes alleges there was no mechanism to prevent the gun from firing without the clip and that Coleman and Damper failed to make sure the gun was not loaded. Holmes alleges he suffered permanent and disabling injuries. 

Holmes seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Attorney Sylvester Anderson in Houston.
