Air cargo delivery driver sues Ryder, claiming defective truck ladder caused fall, injuries

HOUSTON — An air cargo delivery driver is claiming a defective ladder on a Ryder truck caused him to fall and suffer injuries, including a fractured foot.

Victor Modica filed a complaint May 14 in Harris County District Court against Ryder Logistics LLC, alleging negligence. 

Modica was working as a driver for Land Air's Kafco division on Nov. 16, 2018. He alleges that while picking up cargo at Houston's Intercontinental Airport using a Ryder truck, the ladder to the cab of the truck moved unexpectedly, causing him to fall to the ground. Modica claims he suffered a fractured foot and other injuries due to Ryder's negligence in inspecting the truck's equipment. 

Modica seeks monetary relief between $200,000 and $1 million, interest, trial by jury and all other just relief. He is represented by Loren Klitsas of Klitsas & Vercher PC in Houston.
