Man sues Houston event venue after COVID-19 social distancing mandates prohibited use of rental space

HOUSTON — A man who paid The Springs event venue more than $7,000 for a wedding reception is claiming he is owed a refund, since the state's COVID-19 social-gathering mandates prohibited the use of their Tuscany Hall for the event. 

Lyl Rymer filed a complaint May 22 in Harris County District Court against The Springs Events LLC, alleging breach of contract. 

Rymer entered into a contract with The Springs on June 16, 2019, for the use of The Springs' Tuscany Hall facility and services for a wedding reception on May 30, 2020, for 225 guests. Rymer alleges in his complaint that he paid The Springs a $1,812.50 deposit and three payments, for a total of $7,250, per the terms of the contract. He claims The Springs "cannot comply with its obligations in the written contract" due to the state's COVID-19 rules for social gatherings, which mandate a limit of 100 people, or 25% capacity of Tuscany Hall. Rymer alleges The Springs refuses to give him the refund he is entitled to and that they have breached the contract and shown "an act of bad faith."

Rymer seeks monetary relief of $7,250, trial by jury, interest and all other just relief. He is represented by Nathan Rymer of Rymer, Echols, Slay & Nelson-Archer PC in Houston.
