HOUSTON — A Houston dental practice is facing a lawsuit by one of its former dental assistants, claiming he was not paid overtime wages in violation of federal law.
Juan Carlos Delgado filed a complaint June 16 in the Houston Division of the Southern District of Texas against Salinas Dental Group PA and Adriana Salinas individually, alleging violation of the Fair Labor Standards Act (FLSA).
Delgado worked as a dental assistant at Salinas Dental Group for three years. He alleges in his complaint that Salinas misclassified its "nonexempt employees" to avoid paying overtime compensation. Delgado claims he worked more than 40 hours each week without receiving pay for overtime and that Salinas "knowingly and willfully" violated the FLSA. Delgado alleges that Salinas generated at least a half a million dollars in gross annual revenues but still failed to compensate its employees properly for overtime work in accordance with federal law.
Delgado seeks monetary relief, interest and all other just relief. He is represented by Mark Siurek and Patricia Haylon of Warren & Siurek LLP in Houston.
