Plaintiffs claim rented golf cart's brakes failed resulting in collision

GALVESTON — A Galveston Golf Cart rental business is facing a suit by several plaintiffs who allege they were seriously injured in a collision when the cart's brakes failed. 

Melissa Rosales, individually and as next of friend of M.G., and I.G., minors and Patricia Fernandez as next of friend of M.J., minor filed a complaint Oct. 13 in the Galveston County District Court against Galveston Golf Carts LLC and John Hall, Jr., alleging negligence. 

According to the complaint, the plaintiffs were riding in the defendants' golf cart on Aug. 17, 2020. They allege that the cart "malfunctioned" and failed to "brake properly" which caused a collision. The plaintiffs allege they suffered "severe injuries and damages" including medical bills, mental anguish, physical pain and "loss of enjoyment of life in the past and in the future." 

They claim the defendants are negligent for failing to "exercise ordinary care" that resulted in the golf cart's malfunction and failure. 

The plaintiffs seek monetary relief, trial by jury, interest and all other just relief. They are represented by Sean Roberts, Rob Cantu and Noah Horwitz of Roberts Markland LLP in Houston.
