Couple alleges Austin company breach of contract in 'wrap' real estate transaction

HOUSTON — Eliseo Borrego and Lidia Borrego filed a complaint Oct. 28 in Harris County District Court against MVA Properties LLC, Yeferson Gonzalez Garcia, Monica Muniz and Jose Muniz alleging breach of contract, civil conspiracy and other claims. 

According to the plaintiff's complaint, earlier this year, they contacted Monica Muniz regarding their interest in purchasing a home located in Houston that was listed for sale by MVA. The Borregos allege that on May 20, 2020, Yefferson told them verbally and through a residential contract that MVA would sell them the property through owner financing and that the property would be "free and clear" after closing. 

They claim Yeferson and MVA made false representations and closed a mortgage on the property on July 9, 2020, with the paperwork being signed by defendants Jose and Monica Muniz. They also claim Jose Muniz attempted to get them to sign an amendment to their contract to purchase the home through owner financing with the lien MVA had already authorized. The Borregos claim they had already paid $15,000 while awaiting the closing. 

The Borregos seek monetary relief of no less than $200,000, interest and all other just relief. They are represented by Attorney Hector Chavana, Jr., in Houston.
