HOUSTON — A man is claiming negligence after allegedly tripping and smashing his face in the parking lot while leaving the Houston Live Stock Show and Rodeo in 2019.

Gerard Lapointe filed a complaint Nov. 23 in Harris County District Court against Houston Livestock Show and Rodeo Inc., Aramark Sports and Entertainment Services of Texas LLC and ASM Global LLC alleging premises liability and negligence.

According to Lapointe's suit, he and his family were business vendors attending the Houston Livestock Show and Rodeo at NRG Stadium in Houston on March 4, 2019. Lapointe claims as they left the stadium and were walking towards the parking lot that evening after dark, he "tripped violently" with his face "smashing" into the asphalt.

Lapointe alleges the negligence of the defendants for having poor lighting and an "unkempt" parking lot. He also alleges the defendants failed to keep their property in a "reasonably safe condition" by failing to maintain their premises and correct the dangerous lighting and pavement.

Lapointe claims the defendants "had actual or constructive knowledge" of the parking lot's condition and failed to reduce or eliminate the alleged risk.

Lapointe seeks monetary relief between $250,000 and $1 million, trial by jury and all other just relief.

He is represented by Nichole Nech of The Nech Law Firm PC in Houston.
