Driver for Tetrasolv Services was looking at cell phone when he caused collision, suit alleges

HOUSTON – A lawsuit has been brought against Tetrasolv Services, alleging one of its drivers caused a collision because he was looking at his cell phone.

Seeking more than $1 million in damages, Alex Chavez filed suit against Tetrasolv Services on Jan. 11 in Harris County District Court, also naming Larry Jackson as a defendant.

According to the lawsuit, on Dec. 18 Chavez was traveling on Highway 90. Jackson was operating a tractor-trailer owned by Tetrasolv Services ahead of Chavez in the same lane.

“Defendant Jackson was distracted and looking at his phone - as confirmed by witnesses and with the responding police officer,” the suit states. “Due to this, Defendant did not see a construction convoy ahead of him, and ended up hitting a construction convoy truck. In doing so, Defendant’s truck also suddenly ended up partially in both lanes, and at an abrupt, complete stop.

“This further limited evasive action for vehicles behind him, and Chavez could not avoid a collision with Defendant.

As a result of the incident, Chavez injured her chest, knee, legs and back.

Chavez is accusing the defendants of gross negligence and is seeking damages for her mental anguish, pain, impairment, disfigurement, medical expenses, loss of earning capacity and loss of household services.
