Man claims he was hit with service cart aboard United Airline flights

HOUSTON — A man claims he suffered serious elbow injuries when he was struck in the same elbow with a service cart on two separate United Airline flights. 

Scott Walkinshaw filed a complaint  Feb. 1 in Harris County District Court against United Airlines Inc., alleging negligence. 

According to his complaint, Walkinshaw was a first class passenger on a United flight on April 23, 2019. He alleges that during the meal service on the flight, flight attendants "came barreling up the aisle" with the service cart which was not supposed to be in the first class cabin, and struck his right elbow that was "protruding slightly" as he cut up food. Walkinshaw further alleges that he again flew on United on Dec. 17, 2019, and that the plane for the route was an aircraft with "one of the most narrow aisles in United's fleet." 

He claims a flight trainee who was left unsupervised moved the service forward from behind him and struck him in the same elbow while he was working on his laptop. Walkinshaw claims he suffered worsening injury to his elbow that has resulted in "permanent" nerve damage.

Walkinshaw seeks monetary relief of at least $75,000, trial by jury and all other just relief. He is represented by Robert Lapin of Lapin & Landa LLP in Houston.
