HOUSTON — A restaurant in Katy is facing a suit alleging they failed to properly light and mark a step in the bar area which allegedly caused a woman to fall and suffer injuries.

Claudia Bernal filed a complaint Feb. 11 in Harris County District Court against Perry's Restaurant alleging premises liability and negligence.

According to her complaint, Bernal was dining at Perry's Restaurant on Cinco Ranch Boulevard in Katy on Aug. 8, 2019. She alleges that when she got up to go the restroom, she took a step and fell to the ground. Bernal claims that only after she fell to the ground, she saw a step under the table that she did not see before due to poor lighting in the bar area. She also claims the step was unmarked and "in an unexpected location." Bernal alleges she suffered "serious" injuries," along with mental anguish and has incurred medical expenses. She claims Perry's was negligent in failing to clearly light and mark the stair and that the restauant failed to use reasonable care.

Bernal seeks monetary relief between $100,000 and $200,000, interest, trial by jury and all other just relief. She is represented by Attorney Kevin Connolly in Houston.
