In a dramatic legal move, an individual has filed a lawsuit against one of the world's largest retail corporations, alleging negligence that led to serious injuries. On March 21, 2025, Francisco Carrizales lodged a complaint in the District Court of Harris County, Texas, against Walmart, Inc., claiming damages exceeding $1 million.
The case revolves around an incident that occurred on August 3, 2023, at a Walmart Supercenter located at 1107 Shaver St, Pasadena, Texas. According to the plaintiff's petition, Carrizales was shopping when he slipped and fell on an unidentified substance on the floor. The complaint asserts that there were no warning signs or barriers to alert customers about the hazardous condition. "Defendant either created the condition and/or failed to correct the condition or to warn Plaintiff of the dangerous condition," states the petition. This alleged negligence forms the basis for Carrizales's claims of premises liability and negligence against Walmart.
Carrizales argues that Walmart had continuous and systematic contacts with Texas sufficient to establish jurisdiction over them. He further contends that Walmart failed in its duty as an occupier of premises by not maintaining a safe environment for customers. The complaint details several alleged lapses by Walmart and its employees: failing to maintain safe conditions, neglecting proper inspection protocols, and inadequately training staff on safety procedures. "Defendant through its employees and/or agents failed to maintain the area in a reasonably safe condition," reads one section of the filing.
The plaintiff is seeking monetary relief for various damages including past and future medical expenses, physical pain and suffering, loss of earnings and earning capacity, loss of household services, mental anguish both past and future. Additionally, Carrizales demands pre-judgment interest from the date of injury through judgment date at maximum rates allowed by law.
